TERMS & CONDITIONS*

*Below are the terms and conditions that apply when booking a reservation with Coastal Home and Villa. After your booking is confirmed, you will receive a Guest Rental Agreement via email within one (1) business day that must be reviewed, signed, and returned to Coastal Home and Villa within seven (7) days after you receive it.

  1. Agency Disclosure. Coastal Home and Villa (CHV) operates under a real estate license issued by the South Carolina Department of Labor, Licensing, and Regulation. Through this license, CHV acts as the authorized agent for the Property owner.
  2. Initial Deposit. A forty percent (40%) deposit of the total rent amount, plus full payment of the Reservation Fee and any travel insurance premiums (if selected), and any applicable taxes to these amounts, will be required at the time of booking to secure the reservation. Payment shall be made either through check or accepted credit card. Checks must be received within seven (7) days of the booking being made or the reservation will be subject to immediate cancellation. CHV may elect not to accept a check payment in instances where full pre-payment of the reservation would be due upon booking. A thirty-five-dollar ($35.00) fee will apply to any returned checks.
  3. Final Payment. The balance of the remaining total booking amount is due:
    1. For Villas no later than forty-five (45) days prior to arrival
    2. For Private Homes no later than sixty (60) days prior to arrival
    3. For Any Long Term Stay in either a Villa or Private Home greater than twenty-seven (27) days no later than ninety (90) days prior to arrival
  4. Cancellation Policy. Reservations cancelled by Guest between the booking date and up to the date that the Final Payment is due (the "Cancellation Period") will receive a refund of monies paid, less a cancellation fee equal to one hundred percent (100%) of the Reservation Fee charged plus any applicable paid Travel Protection Plan premiums & taxes. Changes to dates and property selection cannot be made within the Cancellation Periods. No refunds will be given for Guest no-shows or early departures. No refunds will be issued for any situation, including evacuations, arising from hurricanes, or other severe weather. Guest is encouraged to review travel insurance options available to them, either offered through CHV, or other providers, that may allow for coverage in these, and other, situations. Reservations are non-refundable if not cancelled within these Cancellation Periods:
    1. For Villas - at least forty-five (45) days prior to Guest arrival
    2. For Private Homes - at least sixty (60) days prior to Guest arrival
    3. For any Long Term Stay in either a Villa or Private Home, greater than twenty-seven (27) days in length - at least ninety (90) days prior to Guest arrival
  5. Dog Friendly Properties. In the event that dogs are allowed in the Property, Guest must seek pre-approval from CHV prior to the commencement of the rental term. CHV may charge a non-refundable dog fee of two hundred fifty dollars ($250.00) to Guest. Dogs are only allowed in designated dog-friendly properties. A maximum of two dogs are permitted in dog-friendly properties only. If Guest fails to comply with these requirements, including not seeking pre-approval, CHV may charge additional cleaning fees to Guest or immediately terminate the rental, and Guest shall forfeit all monies paid in connection with the rental.
  6. Registered Guest. The Guest named above will be identified as the registered Guest for the purpose of this Agreement and will assume full financial and legal responsibility for all occupants of the property, including their guests, during the term of this Agreement.
  7. Term and Termination. Tenancy for Guest (the "Rental Term") will begin at the commencement of Guest arrival to Property on the Arrival Date stated on this Agreement and terminates upon Guest departure from Property as stated on this Agreement. The terms and conditions set forth in this Agreement shall begin on the date that it is signed and returned by Guest to CHV and continue through the end of Guest tenancy.
  8. Return of this Agreement. If Agreement is not signed and returned to CHV within seven (7) calendar days of the booking date, CHV may deem reservation abandoned and provide cancellation notice to Guest along with a refund of any initial payment being held, less a cancellation fee equal to one hundred percent (100%) of the Reservation Fee charged. In order for the reservation to be fully confirmed, both the initial deposit and a signed copy of this Agreement must be on file with CHV.
  9. Reservation Corrections. CHV has the right to correct posted rates or availability dates within seventy-two (72) hours of confirming any reservation if the reservation has been inadvertently misquoted due to human or technology error. In these situations, Guest will have the option of cancelling without penalty if they do not wish to accept the amended rate or availability date upon being notified. All rates and fees are quoted in U.S. dollars.
  10. Guest Authorizes Credit Card Charge. If final payment information is not received from Guest by the payment dates outlined in Paragraph 3 "Final Payment", Guest authorizes CHV to charge the credit card(s) on file for any remaining balance. If final payment is declined and CHV is unsuccessful in obtaining an alternative method of payment from Guest, then CHV may deem the reservation abandoned and may retain monies on file, pursuant to the cancellation terms outlined in Paragraph 4 "Cancellation Policy".
  11. Security Deposit and Credit Card Requirement. CHV may, in its sole discretion, request and hold a security deposit for any rental transaction that it deems necessary. In lieu of a security deposit being requested, CHV requires a valid credit card to be held on file prior to allowing Guest access to the Property, which by default will be any card(s) used by Guest in making the Initial Deposit or Final Payment on the reservation. This credit card will secure any expenses for additional service charges related to services requested by Guest during the stay and will be used as means to recover expenses related to property damage outlined in Paragraph 17 "Damage to Property".
  12. Settlement of Additional Charges and Damages. Guest hereby agrees that any credit card used in this transaction can be used to settle any additional service charges and for the reimbursement of necessary repair expenses as a result of Guest's damage to Property, if any.
  13. Travel Protection Insurance Available. We offer optional travel protection insurance provided through Red Sky Travel Insurance. The premium is calculated at the time of booking and may be optionally added to your reservation up to the final payment date. Details about the coverage and questions concerning Red Sky Travel Insurance can be obtained by reviewing the certificate of insurance on their website www.trippreserver.com or by calling Red Sky Travel Insurance at 866-889-7409.
  14. Funds Held in Escrow. Pursuant to South Carolina Real Estate law, all rental transaction funds will be held in an escrow account with a bank that is authorized to do business in the state of South Carolina. GUEST HEREBY ACKNOWLEDGES THAT CERTAIN REVENUE COLLECTED BY CHV SHALL ACCRUE INTEREST IN CHV'S INTEREST-BEARING ESCROW ACCOUNT. GUEST HEREBY RELINQUISHES ANY RIGHT TO OWNERSHIP OF SUCH ACCRUED INTEREST AND THEREFORE ALLOWS THE RELEASE OF ALL INTEREST TO CHV.
  15. Right to Terminate. CHV may terminate this Agreement (and Guest occupancy if during rental term), retain monies pursuant to the cancellation policy outlined in Paragraph 4 and terminate occupancy, if applicable, at any time if Guest is found in breach of the terms of this Agreement prior to or during the occupancy of Property, to include but not limited to not meeting the minimum rental age requirement set forth in this Agreement, exceeding maximum occupancy limits of Property, occupying Property with a dog without prior approval, use of the Property for an event without prior approval, or if Guest is found to be damaging Property or using Property in an unsafe manner.
  16. Right to Relocate Guest. Guest acknowledges that CHV may need to attempt to relocate Guest to a comparably priced property in the event unforeseen circumstances prevent the occupancy of Guest in the Property before the rental term. These circumstances include, but are not limited to, a change in property ownership or a change in property availability due to damage, maintenance issue, or Property owner directive. If CHV is unable to provide a suitable alternative to Guest, CHV will issue a full refund to Guest of monies on file, without deduction. In no event will CHV be responsible for any direct or indirect costs, expenses, fees, or other consequential damages resulting from the unavailability of a specific accommodation.
  17. Damage to Property. Guest is responsible for any damage (including theft) to Property, and its contents, that may occur during the duration of the rental term. Guest is responsible for their actions and the actions of their guests, where applicable. CHV will inspect property prior to Guest arrival and after Guest departure. Guest is advised to notify CHV within a reasonable period after arrival to report any damage observed upon their arrival, that was not caused by Guest.
  18. Additional Cleaning and Service Fees. CHV may assess additional cleaning and service fees to Guest as a result of Guest's occupancy. These fees include, but are not limited to: (i) housekeeping, linen replacement, or general cleaning fees due to excessive occupancy, use, or misuse of Property by Guest in order to return Property to rentable condition, (ii) pool maintenance fees due to Guest's misuse of swimming pools or hot tubs, if applicable, and (iii) landscape maintenance fees due to guest's misuse or littering of Property grounds and surrounding areas.
  19. Guest Personal Property. Guest is solely responsible for the safekeeping of all personal items of guest and guest's invitees while renting the property. CHV strongly recommends that guest keep the property properly locked and secured at all times during the rental period. Neither CHV nor the property's owner shall be responsible for any lost, stolen, or damaged personal property of guest or guest's invitees, including any personal property left behind in the property following the conclusion of the rental period. If guest has safety questions or concerns about the property they must notify CHV immediately.
  20. Property Accepted "As-Is, Where-Is.", Guest agrees to accept occupancy of the Property in "as-is" condition, and accepts the location of the Property "where-is". CHV shall make commercially reasonable efforts to address any alleged deficiency or service interruption with respect to the Property in a timely manner. Guest hereby waives the right to withhold any rent or other monies from CHV to be compensated, reimbursed or otherwise made whole for any such alleged deficiency or service interruption.
  21. Access. Guest agrees to allow CHV, or CHV's assigned vendors or contractors, to enter the Property during reasonable hours for the purpose of making inspections, obtaining estimates, making repairs, or any other purpose including inspections if CHV feels that the Guest's use of Property is in violation of this Agreement or an inspection is necessary to protect the Property or the Owner's interest in the Property. CHV may enter the Property, at any time, in the event of a real or perceived emergency. Guest may not refuse CHV, or a CHV approved vendor, access to the Property to inspect equipment or appliances or make any necessary repairs, as determined by CHV.
  22. Pools and Hot Tubs. Select private homes have private pools and private hot tubs that are able to be heated seasonally for an additional fee. CHV requires fourteen (14) day advanced notice from Guest to heat these pools and hot tubs. Guest must contact CHV to confirm heating availability and pricing. Guest is advised that jet pumps for hot tubs will not work unless heat is activated. Additional pool and hot tub use instructions will be available in Property, if applicable. Due to the mechanical nature of pool and spa amenities, CHV will not be responsible for any pool or hot tub heating failure during Guest's occupancy. CHV will refund Guest a prorated amount of the unused heating fee paid. CHV is under no obligation to relocate Guest due to pool and spa heater malfunctions nor offer an additional refund above the remaining prorated unused heating fee paid. Guest acknowledges that certain villas and private homes share complex pool and spa access. These facilities are not managed by CHV and CHV will not be responsible for any anything related to these facilities.
  23. Housekeeping & Linen Services. CHV will ensure property is clean to its general standards prior to Guest occupancy, but will not guarantee that the completion time coincides with the start of the check-in window. CHV will supply bed linens and bath towels in the Property based on total bed count and occupancy limits of the Property, in addition to a starter supply of bathroom and kitchen amenities. Guest will be responsible for additional supplies needed during their rental term. CHV can provide daily housekeeping and linen service at an additional charge to Guest. All linens must remain in the Property and Guest may be responsible for the cost of replacing missing or damaged linens and towels. Guest agrees to make Property available for cleaning beginning at 10:00am on Guest's departure date.
  24. Maintenance Services. CHV does not guarantee the performance of equipment and appliances within the Property, including HVAC and swimming pool systems. Guest acknowledges that equipment malfunctions and failures cannot be predicted nor often prevented. In the event that a repair to equipment or appliances within the Property is necessary CHV shall use commercially reasonable efforts to make such repairs in a timely manner. Guest may not make service calls to outside contractors without the express permission of CHV. Any service calls ordered by Guest from an outside contractor shall be the sole responsibility of the Guest and shall be cause for CHV to terminate the rental and Guest shall forfeit all monies in connection with the rental.
  25. Neighborhoods, Complexes, and Surrounding Areas. Guest agrees and acknowledges that CHV has no control over surrounding construction noise, disruption, elevator problems within neighborhoods, buildings or complexes, exterior repairs to condominium and villa complexes, and the scheduling of certain services for such complexes.
  26. Utility Service. Guest agrees and acknowledges that CHV has no control over or responsibility for mechanical, technical, and service related problems with utility services such as, but not limited to, electric, gas, water, sewer, telephone, cable television, and internet outages. Upon being made aware of a utility service outage, CHV will notify the service provider or try to correct the problem in a timely manner, but CHV will not be liable for any such damages or delays, or discomfort related to interruptions out of CHV's control.
  27. Indemnification. Guest agrees to indemnify and hold the owner of title to the Property, CHV, CHV's employees, agents, successors and assigns, from and against any and all liabilities, actions, lawsuits, proceedings demands, injuries to person or property losses, damages, expenses, claims and costs, including reasonable attorney's fees and court costs, arising, indirectly or directly out of or incident to Guest's use and occupancy of the Property harmless from any liability, claim, or expense, including expenses incurred to defend against the same, for injury, damage or loss arising in connection with, or with respect to, Guest's, including Guest's invitees or licensee's use and occupancy of Premises (including the Property and any property, pools, hot tubs or equipment located within or on the premises of the Property or any injury to person). CHV shall not be responsible or liable for the condition of the Property or any other obligation of CHV and CHV's employees, agents, successors and assigns shall not be liable to Guest, Guest's invitees or licensees for any action or inaction, error of judgment, or mistake of fact or law, except in case of willful misconduct or gross negligence by CHV.
  28. Assignment. CHV may assign this Agreement to another rental company. Guest may not assign or transfer this Agreement without consent of CHV.
  29. Entire Agreement. This Agreement, the Terms and Conditions and the Privacy Policy represent the entire agreement between CHV and Guest with respect to the subject matter hereof and supersedes all prior and contemporaneous negotiations, representations or agreements, either written or oral, relating thereto. Modifications of this Agreement shall not be binding unless made in writing and signed by authorized representatives for both parties. This Agreement may be executed in multiple counterparts, each of which shall be deemed an original, but both of which together shall constitute one and the same instrument. Facsimile and other electronic copies of the manually executed version of this Agreement shall be fully binding and effective for all purposes.
  30. Rental Terms and Conditions. The terms and conditions accepted by Guest at the time of reservation (the "Terms and Conditions") are hereby incorporated by reference into this Agreement. Guest acknowledges that Guest has read and accepted the Terms and Conditions and any violation of such Terms and Conditions shall constitute a breach of the terms of this Agreement.
  31. Governing Law/Venue. It is mutually agreed that this Agreement is a legally binding agreement and that any disputes or legal proceedings that may arise out of this Agreement by either party shall be brought in Beaufort County, South Carolina. The laws of the State of South Carolina shall govern this Lease. IT IS FURTHER AGREED THAT UNDER NO CIRCUMSTANCES WILL THE AGGREGATE LIABILITY OF THE PROPERTY OWNER OR CHV BE MORE THAN THE TOTAL AMOUNT PAID BY GUEST UNDER THIS LEASE. THE PARTIES WAIVE THE RIGHT TO A JURY TRIAL IN ANY ACTION RELATED TO THIS AGREEMENT, THE PROPERTY OR THE RELATIONSHIP BETWEEN GUEST, CHV, AND THE PROPERTY OWNER AND THEIR RESPECTIVE SUCCESSORS AND ASSIGNS.
  32. Rental Policies and Restrictions.
    1. Check-in Time. Check-in time is after 4:00 pm on the date of arrival. CHV will make every effort to ensure Property is ready by 4pm, but does not guarantee it. Guest acknowledges no adjustment to rent will be given for a delayed check-in time.
    2. Check-out Time. Check-out time is before 10:00 am on the date of departure. Guest is responsible for securing the doors and windows of the Property, returning all keys and other assigned items to CHV's office upon departure. Late check-outs require CHV approval and may be subject to an additional fee equal to twenty percent (20%) of the Property's daily rate per hour beyond 10:00am.
    3. Minimum Age to Rent. Guest acknowledges that Guest listed on this Agreement is at least 25 years of age and will personally occupy the Property throughout the term of the rental. If CHV determines that Guest is less than 25 years of age, CHV may, in its sole discretion, immediately terminate the Guest's occupancy, evict the Guest and all of Guest's invitees from the Property and all monies paid by Guest shall be forfeited.
    4. Occupancy. Occupancy of the Property is limited to the maximum number of persons stated in the Property's description on CHV's website. Private events (including weddings) within the Property must be approved in advance in writing and may require a substantial security deposit.
    5. All Properties are Non-Smoking. Smoking is not permitted in Property. Guest will be charged a minimum additional fee of five-hundred dollars ($500.00) to cover necessary cleaning expenses. CHV may also elect to terminate the rental without refund, in certain cases.
    6. Furniture Placement. Guest agrees not to move furniture in the Property, with the exception of furniture items identifiable as being readily movable, such as dining chairs, small ottomans, and stools. Guest will use caution and care when moving items in the house.
    7. Use Restrictions. The Guest acknowledges the Property's owner may restrict CHV from providing access to certain areas of the Property, at their sole discretion, to include but not limited to, certain closets, cabinets, rooms, garages, attics, and service areas. Guest also agrees to abide by all Federal, State, and Local laws and ordinances, including any Planned Unit Development covenant, condition, or restriction while occupying the Property. Additionally, Beaufort County has a no fireworks ordinance.
    8. Noise. Pursuant to Town of Hilton Head ordinance, noise is to be limited each day between the hours of 10:00 PM and 7:00 AM. Guest agrees and acknowledges that Guest and Guest's invitees shall not create excessive noise in and around the Property during the rental period. If CHV determines that Guest is in repetitive violation of this ordinance, CHV may, in its sole discretion, immediately terminate the Guest's occupancy, evict the Guest and all of Guest's invitees from the Property and all monies paid by Guest shall be forfeited.
    9. Community Restrictions on Vehicles. Guest is advised that for Properties located within Sea Pines, Palmetto Dunes, and Shipyard plantations, that vehicles entering these communities may be subject to gate fees and access limitations on the number of vehicles allowed to be parked at the Property. CHV charges the Guest based on the exact number of car passes the guest requests. Car passes are non-refundable once CHV has purchased them. Additionally, motorcycles, campers, trailers, recreational vehicles, vehicles with logos, and watercraft trailers are prohibited from entering these communities.
    10. Sea Turtle Ordinance. The Town of Hilton Head Island has exterior lighting restrictions for all oceanfront and certain near ocean properties that prohibit the use of any visible lighting from the beach areas between May 1st and October 31st of each year for the purpose of protecting sea turtle nests. Guest will be responsible for any fines levied by the Town for non-compliance.
  33. Binding Agreement. Once the Agreement has been signed it shall be binding upon the parties. If Guest does not understand any part of the Agreement, further advice should be sought. Guest must certify that Guest has reviewed and agreed to the terms and conditions of the Agreement. Any alterations to the Agreement shall be unenforceable, unless initialed by both Guest and CHV.
  34. Credit Card Authorization for Additional Charges. Guest authorizes that the credit card(s) used as payment towards this reservation may also be used for any additional charges for requested services by Guest unless alternative payment is offered at the time of the transaction. Additionally, Guest authorizes that the same credit card(s) may be used to pay any obligations for which Guest is responsible under this Agreement, including any property damage that may occur during the rental term, in lieu of CHV requesting a cash security deposit upon check-in.

Authorized Signature. The Guest signing the Agreement must be a person listed on the reservation and the cardholder, or authorized user, of a credit card on file for this reservation.
